Terms of Use (English)

These Terms of Use (the "Terms") govern your use of the Mood-Ring Weather mobile application (the "App") provided by Teciora ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App, in one sentence

The App converts weather data into a single comfort score — the Mood Ring Index (MRI, 0–100) — and related indicators, so you can understand at a glance how the weather is likely to feel.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the App. If you are a minor under the laws of your country, you must have your parent's or guardian's consent.

3. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial purposes. You agree not to:

• reverse engineer, decompile, or attempt to extract the source code of the App, except where such restriction is prohibited by applicable law;
• interfere with, overload, or circumvent any technical limitation, rate limit, or security measure of the App or its backend services;
• resell, sublicense, or redistribute the App or the data it displays as a standalone product or service;
• use the App for any unlawful purpose, or in any way that infringes the rights of others.

4. Weather information is an estimate — not an official alert

This is the most important section of these Terms. Please read it.

• The MRI and all other indicators in the App are calculated estimates derived from third-party weather data. They are provided for reference and convenience only.
• The App's heat-related notifications are not a redistribution of official alerts issued by the Japan Meteorological Agency (JMA), the Ministry of the Environment of Japan, or any other public authority. They are the App's own determination, calculated independently from Open-Meteo weather data. For any decision that matters, consult the official information published by the JMA and the Ministry of the Environment (or the equivalent authority in your country).
• Where the App uses thresholds that align with public heat-index standards, that alignment exists for consistency. It does not mean the App speaks for, or on behalf of, any public authority.
• Weather forecasting is inherently uncertain. Actual conditions may differ materially from what the App shows.
• Notification delivery depends on your device, operating system, network, and permission settings, and on third-party services outside our control. We do not guarantee that any notification will be delivered, delivered on time, or delivered at all. Do not rely on the App as your only source of safety information.

5. Not medical advice

The App is not a medical device and does not provide medical advice, diagnosis, or treatment. The MRI, the personal calibration feature, and any comfort or heat indicator are not an assessment of your health. They must not be used to diagnose, treat, cure, or prevent any illness or condition, including heatstroke or any other heat-related illness.

If you feel unwell, or if you believe you or another person may be experiencing a heat-related illness or any other medical emergency, contact a medical professional or emergency services immediately. Do not wait for, or rely on, the App.

6. Free features, and Mood-Ring Weather Plus

6.1 Emergency safety notifications are free, permanently

Emergency safety notifications — including heat-stroke, strong-wind and heavy-snow alerts, and any further emergency safety notification we add in the future — are, and will remain, available to every user at no charge. They are never placed behind a paid subscription, never counted against any paid quota, never delayed for non-subscribers, and never reduced in scope or accuracy for users who do not subscribe. Your subscription status has no effect on whether you receive them. This commitment applies for as long as we operate the App.

These notifications are the App's own determination and are not a redistribution of official warnings; §4 applies to them in full, including the limits on delivery described there.

6.2 Plus subscription

Mood-Ring Weather Plus ("Plus") is an optional auto-renewing subscription that adds convenience and personalisation features. Plus does not unlock safety notifications, because those are already free under §6.1.

• Price and term are shown in the App and on the App Store / Google Play at the point of purchase, in your local currency, before you confirm. Prices vary by country and may change; any change applies only to future billing periods and, where required by law or store policy, only after notice to you.
• Auto-renewal. Unless you cancel at least 24 hours before the end of the current period, the subscription renews automatically for the same term, and your store account is charged the then-current price.
• Free trial. Where a free trial is offered, it converts to a paid subscription at the end of the trial period unless you cancel before it ends. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial.
• Cancellation and refunds are handled by the store, not by us. Manage or cancel your subscription in your Apple ID subscription settings or Google Play subscription settings. We cannot cancel your subscription or issue refunds on the store's behalf. Refunds are governed by Apple's and Google's respective policies and by your statutory rights.
• Restore purchases. If you reinstall the App or change devices, use the in-app "Restore purchases" function with the same store account.

7. Intellectual property and third-party data

• The App, its interface, the mood-ring visual design, the MRI methodology, and all related trade marks and content are owned by us or our licensors. These Terms grant you no rights in them other than the licence in §3.
• Weather data is provided by Open-Meteo and other third-party sources, and is subject to those providers' own terms and licences. We do not own that data and do not warrant its accuracy, completeness, or availability.

8. Disclaimer of warranties and limitation of liability

• The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
• To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or relating to your use of the App.
• To the fullest extent permitted by applicable law, our total aggregate liability arising from or relating to the App is limited to the greater of (a) the amount you paid us for the App in the twelve months preceding the event giving rise to the claim, or (b) JPY 1,000.
• Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for wilful misconduct or gross negligence. If you are a consumer, your mandatory statutory rights are unaffected by these Terms.

9. Privacy

Our handling of your information is described in our Privacy Policy, which forms part of these Terms. In summary: the App is designed to know as little about you as possible while still working well.

10. Changes, suspension, and termination

• We may modify these Terms. If a change is material, we will give reasonable notice in the App or on this page before it takes effect. Continuing to use the App after a change takes effect means you accept the revised Terms. If you do not accept them, stop using the App.
• We may modify, suspend, or discontinue the App or any feature at any time. Where we discontinue a paid feature you have already paid for, you may be entitled to a pro-rata refund through the relevant store.
• You may terminate these Terms at any time by deleting the App. Sections 4, 5, 7, 8, and 10 survive termination.

11. Governing law and jurisdiction

These Terms are governed by the laws of Japan, and the Sapporo District Court has exclusive jurisdiction as the court of first instance. If you are a consumer resident outside Japan, this clause does not deprive you of the protection of the mandatory consumer-protection laws of your country of residence, or of your right to bring proceedings in the courts there where such a right cannot lawfully be excluded.

本利用規約（以下「本規約」）は、Teciora（以下「当方」）が提供するモバイルアプリ「Mood-Ring Weather」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロード、インストール、または利用された時点で、本規約に同意したものとみなします。同意されない場合は、本アプリをご利用にならないでください。

1. 本アプリの要旨

本アプリは、気象データをひとつの快適度スコア「Mood Ring Index（MRI、0〜100）」および関連指標に変換し、天気の体感を一目で把握できるようにするものです。

2. 利用資格

本アプリのご利用は、13 歳以上（またはお住まいの国で定められたデジタル同意年齢のうち、いずれか高い方）の方に限ります。お住まいの国の法令上未成年である場合は、親権者または法定代理人の同意を得てご利用ください。

3. ライセンスおよび禁止事項

当方は、お客様ご自身の非商業的な目的のために本アプリを利用する、個人的・非独占的・譲渡不可・撤回可能な権利を許諾します。次の行為は禁止します。

• 本アプリのリバースエンジニアリング、逆コンパイル、ソースコードの抽出を試みる行為（適用法令により当該制限が禁止される場合を除く）
• 本アプリまたはそのバックエンドの技術的制限・レート制限・セキュリティ機構を妨害、過負荷、または回避する行為
• 本アプリまたは本アプリが表示するデータを、独立した製品・サービスとして再販、サブライセンス、または再配布する行為
• 違法な目的での利用、または第三者の権利を侵害する態様での利用

4. 気象情報は推定値であり、公式アラートではありません

本規約で最も重要な条項です。必ずお読みください。

• MRI および本アプリが表示するすべての指標は、第三者の気象データから算出した推定値です。参考情報としてのみ提供されます。
• 本アプリの熱中症関連通知は、気象庁・環境省その他の公的機関が発表する公式アラートを再配信するものではありません。 Open-Meteo 由来の気象データから本アプリが独自に算出した参考情報です。最終的な行動判断は、気象庁および環境省（国外の場合は各国の相当機関）の公式情報を必ずご確認ください。
• 本アプリが公的な暑さ指数基準に準拠したしきい値を用いる場合、それは整合性のためであり、公的機関を代表・代弁することを意味しません。
• 気象予報には本質的な不確実性があります。実際の気象条件が本アプリの表示と大きく異なる場合があります。
• 通知の到達は、お客様の端末・OS・ネットワーク・権限設定、および当方の管理が及ばない第三者サービスに依存します。当方は、通知が到達すること、所定の時刻に到達すること、およびそもそも到達することを保証しません。 本アプリを安全確保の唯一の情報源としないでください。

5. 医療上の助言ではありません

本アプリは医療機器ではなく、医療上の助言・診断・治療を提供するものではありません。MRI、パーソナルキャリブレーション機能、および快適度・暑さに関する各指標は、お客様の健康状態の評価ではありません。熱中症その他の暑熱による疾病を含むいかなる疾病・症状についても、診断・治療・治癒・予防の目的で使用してはなりません。

体調に異変を感じた場合、またはご自身もしくは他の方が熱中症その他の医療上の緊急事態にあると思われる場合は、直ちに医療機関または救急サービスにご連絡ください。 本アプリの表示を待ったり、これに依拠したりしないでください。

6. 無料機能および Mood-Ring Weather Plus

6.1 緊急安全通知は永久に無料です

熱中症・暴風・大雪などの緊急安全通知(および当方が将来追加する緊急安全通知)は、すべてのお客様へ無料で提供し、今後も無料で提供し続けます。 有料サブスクリプションの背後に置くこと、有料枠の消費対象とすること、未課金のお客様に対して配信を遅らせることや対象範囲・精度を低下させることは、一切ありません。課金状態は、これらの通知が届くかどうかに一切影響しません。本約束は、当方が本アプリを運営する限り継続します。

これらの通知は本アプリの独自判定によるものであり、公的機関の公式警報の再配信ではありません。§4 の定め(配信の限界に関する記載を含む)がそのまま適用されます。

6.2 Plus サブスクリプション

Mood-Ring Weather Plus（以下「Plus」）は、利便性とパーソナライズ機能を追加する任意の自動更新サブスクリプションです。安全通知は §6.1 のとおりすでに無料であるため、Plus は安全通知を解放するものではありません。

• 価格および期間は、購入確定前に、本アプリおよび App Store / Google Play 上でお客様の現地通貨により表示されます。価格は国により異なり、変更される場合があります。変更は将来の課金期間にのみ適用され、法令またはストア規約が求める場合は事前告知の後にのみ適用されます。
• 自動更新。 現在の期間終了の 24 時間以上前に解約されない場合、サブスクリプションは同一期間で自動更新され、その時点の価格がお客様のストアアカウントに課金されます。
• 無料トライアル。 無料トライアルが提供される場合、期間終了前に解約されない限り、終了時に有料サブスクリプションへ移行します。トライアル期間中に有料購入された場合、未消化のトライアル期間は失効します。
• 解約および返金はストアが取り扱い、当方は取り扱いません。 解約・管理は Apple ID のサブスクリプション設定または Google Play のサブスクリプション設定から行ってください。当方がストアに代わって解約や返金を行うことはできません。返金は Apple および Google 各社の方針、ならびにお客様の法定の権利に従います。
• 購入の復元。 再インストールや端末変更の際は、同一のストアアカウントでアプリ内の「購入を復元」をご利用ください。

7. 知的財産権および第三者データ

• 本アプリ、そのインターフェース、ムードリングのビジュアルデザイン、MRI の算出手法、および関連するすべての商標・コンテンツは、当方または当方のライセンサーに帰属します。本規約は、§3 のライセンスを除き、これらに関するいかなる権利もお客様に付与しません。
• 気象データは Open-Meteo その他の第三者から提供され、各提供者の規約およびライセンスに従います。当方は当該データを所有せず、その正確性・完全性・可用性を保証しません。

8. 保証の否認および責任の制限

• 本アプリは現状有姿（as is）かつ提供可能な範囲（as available）で提供され、商品性、特定目的適合性、正確性、権利非侵害に関する黙示の保証を含め、明示・黙示のいかなる保証も伴いません。
• 適用法令が許容する最大限の範囲において、当方は、本アプリの利用に起因または関連して生じた間接損害・付随的損害・特別損害・結果的損害・懲罰的損害、およびデータ・利益・信用の喪失について、責任を負いません。
• 適用法令が許容する最大限の範囲において、本アプリに起因または関連する当方の責任の総額は、（a）請求の原因となった事由の発生前 12 か月間にお客様が当方に支払った金額、または（b）金 1,000 円のいずれか高い方を上限とします。
• 本規約のいかなる規定も、法律上排除または制限できない責任を排除・制限するものではありません。 これには、当方の過失による死亡または人身傷害についての責任、詐欺または詐欺的不実表示についての責任、故意または重過失についての責任が含まれます。お客様が消費者である場合、本規約によって法定の権利が影響を受けることはありません。

9. プライバシー

お客様の情報の取り扱いは、プライバシーポリシー に定めるとおりであり、同ポリシーは本規約の一部を構成します。要旨は「アプリが快適に動作するために必要な最小限しか、お客様のことを知らない」ことです。

10. 変更・停止・終了

• 当方は本規約を変更することがあります。重要な変更を行う場合は、効力発生前に本アプリ内または本ページにて相当な予告を行います。効力発生後に本アプリの利用を継続された場合、変更後の規約に同意したものとみなします。同意されない場合は、本アプリのご利用を中止してください。
• 当方は、本アプリまたはその機能を、いつでも変更・停止・終了することがあります。お客様が既に対価を支払った有料機能を終了する場合、該当ストアを通じた日割り返金を受けられる場合があります。
• お客様は、本アプリを削除することにより、いつでも本規約を終了できます。第 4 条、第 5 条、第 7 条、第 8 条、第 10 条は終了後も存続します。

11. 準拠法および管轄

本規約は日本法に準拠し、札幌地方裁判所を第一審の専属的合意管轄裁判所とします。日本国外に居住する消費者のお客様については、本条は、お客様の居住国の強行法規たる消費者保護法令による保護、および法律上排除できない場合における当該国の裁判所への訴訟提起の権利を奪うものではありません。
